Cancellation Policy & Booking Rules

By booking and/or submitting payment, you acknowledge that you have read, understood, and agreed to the terms below. These terms may be used as written evidence to contest invalid disputes and chargebacks.

1. Acceptance & Chargeback Prevention

  1. 1.1 Binding Agreement. By booking and/or submitting any payment, the guest confirms they have read, understood, and accepted this policy.
  2. 1.2 Authorization. The guest confirms they are authorized to submit payment and that the cardholder (or authorized payer) consents to the charge.
  3. 1.3 Invalid Disputes. Chargebacks filed for reasons covered by this policy—including but not limited to late arrival, check-in time, bridge delays, rain, unused Jet Skis, no-shows, or other guest-caused delays—are considered invalid and will be disputed using written acceptance, timestamps, check-in records, marina logs, messages, and any available documentation.
  4. 1.4 Questions Before Paying. Guests must ask any questions before paying. Completing payment confirms acceptance of these terms.

2. Captain & Crew Selection (Required in Advance)

  1. 2.1 Mandatory Requirement. U.S. Coast Guard regulations require that guests personally select and confirm their captain (and/or licensed crew) before the trip. This is a required process.
  2. 2.2 No Confirmed Captain = Delay. If guests arrive at the marina without a confirmed captain, the trip may be delayed 1–2 hours while we confirm availability and assign a captain approved for the specific vessel and time.
  3. 2.3 Possible Changes. This may require a change of boat and/or departure marina, as not all captains are located at the same marinas and not all captains are permitted to operate every vessel.
  4. 2.4 No Refund. Delays or changes resulting from failure to complete captain selection in advance do not qualify for refunds, credits, discounts, or chargebacks.

3. Weather Policy (No Refund for Rain)

  1. 3.1 Rain or Shine. Charters operate rain or shine. No refunds will be issued due to rain, cloudy skies, or non-hazardous conditions.
  2. 3.2 Safety Exception. Refunds or rescheduling will only be considered if the U.S. Coast Guard issues an official hazardous marine alert, or if the captain determines conditions are unsafe due to storms or severe sea state.
  3. 3.3 Guest Preference. Weather decisions are made strictly for safety. Guest preference does not qualify for refunds.

4. Mandatory Check-In & Contract Signing (Counts Toward Charter Time)

  1. 4.1 Required Process. Guests must complete mandatory check-in and sign a contract (ID verification, safety acknowledgment, and charter agreement).
  2. 4.2 Counts as Charter Time. Check-in time is counted as part of the total charter duration. Guests are advised to arrive 15 minutes early.
  3. 4.3 No Time Added Back. Time spent on check-in will not be added back or refunded at the end of the charter.

5. Punctuality (No Time Extension)

  1. 5.1 No Extension. Late arrivals do not extend charter time. Any time lost due to tardiness is forfeited.
  2. 5.2 Scheduled End Time. The charter ends at the originally scheduled end time, even if guests arrive late.
  3. 5.3 No Partial Refund. No refunds will be issued for time lost due to late arrival or delayed check-in.

6. Late Arrival + Guest Cancellation (No Refund)

  1. 6.1 Guest Decision. If guests arrive late and decide to cancel because they do not want to use the remaining time, the booking remains fully chargeable and non-refundable.
  2. 6.2 Unused Time. No refunds, partial refunds, credits, or discounts will be provided for “unused time.”

7. Miami River Bridge Policy

  1. 7.1 Drawbridges. The Miami River contains multiple drawbridges that open/close throughout the day and may affect navigation timing.
  2. 7.2 Late Arrival Impact. If guests arrive late and the charter is delayed or blocked by bridge openings/closures as a result, no refund will be issued.
  3. 7.3 Route Adjustment. If late arrival prevents access to open water, guests will still enjoy the charter along the Miami River route. The booking remains fully chargeable and non-refundable.
  4. 7.4 No Refund/Discount. Bridge delays caused or worsened by guest tardiness do not qualify for refunds, discounts, partial refunds, or chargebacks.

8. Jet Ski Policy (Reserved in Advance)

  1. 8.1 Pre-Booked Service. Jet Skis are reserved in advance exclusively for your charter.
  2. 8.2 Forfeiture. If guests arrive late and there is not enough time to use Jet Skis, no refund will be issued. Jet Ski costs are forfeited because these services are pre-booked.

9. Fuel & Crew Fees (Always Due in Full)

  1. 9.1 Fixed Costs. Fuel and crew fees must be paid in full even if the full charter time is not used due to late arrival, delayed check-in, bridge delays caused by tardiness, or guest decisions. These are fixed operational costs.

10. Operational Delays (Guest Time Protected)

  1. 10.1 Operational Reasons. If the vessel arrives late due to operational reasons (traffic, final safety checks, or minor repairs required for safe operation), guest charter time begins from the moment guests board the boat.
  2. 10.2 Guest-Caused Delays Excluded. This protection does not apply to delays caused by guest late arrival.

11. Boat Delays Up to 1 Hour (No Cancellation / No Refund)

  1. 11.1 Possible Delay. The vessel may experience delays of up to one (1) hour due to bridge timing, marina traffic, docking constraints, or emergency maintenance required for safe operation.
  2. 11.2 No Cancellation / No Refund. Delays of less than one hour do not qualify for trip cancellation and do not qualify for refunds, partial refunds, credits, or discounts.

12. No-Show Policy

  1. 12.1 Non-Refundable. No-shows are strictly non-refundable. If guests fail to arrive or do not show up for their booking, no refunds will be issued.
  2. 12.2 Reserved Costs. Funds cover reserved crew, marina, operational expenses, and pre-booked services.

13. Safety Instructions & Boat Rules

  1. 13.1 Compliance. All guests must follow captain and crew instructions at all times. Failure to comply may result in early termination of the charter without refund.
  2. 13.2 Strict Rules. Maximum capacity, prohibited items, and onboard conduct rules apply strictly. Violations may result in denied boarding or early termination without refund.
  3. 13.3 Acknowledgment. By booking, guests acknowledge and agree to these policies.
