Your Relationship with Book My Boat
Your use of Book My Boat's website, mobile applications, booking platform, products, services, software, and any related features (collectively, the "Services") is governed by these Terms and Conditions (the "Agreement").
Throughout this Agreement, "Book My Boat," "we," "us," or "our" refers to Book My Boat and its affiliates, representatives, employees, and authorized agents.
If you use our Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have the legal authority to bind that entity to this Agreement.
By accessing, browsing, using, or making a reservation through our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated into this Agreement by reference.
If you do not agree to these Terms, you are not authorized to access or use Book My Boat's Services.
Acceptance of These Terms — You accept these Terms by either clicking the button indicating your acceptance whenever such option is presented, or by accessing or using any part of our Services.
Changes to These Terms — Book My Boat reserves the right, at its sole discretion, to modify, update, replace, or remove any portion of these Terms at any time without prior notice, except where required by applicable law. Any modifications become effective immediately upon being posted on our website. By continuing to use our Services after revised Terms have been published, you agree to be bound by the updated version.
Book My Boat's Role
Book My Boat is an online booking and reservation platform that connects customers ("Renters") with independent boat owners, operators, charter companies, captains, crew members, and other third-party service providers (collectively, "Providers").
Book My Boat does not own, operate, manage, lease, captain, maintain, inspect, or control most of the vessels advertised through its Services. Except where expressly stated otherwise in writing, Book My Boat acts solely as an independent booking facilitator and intermediary.
Book My Boat is not a party to the actual charter agreement, rental agreement, transportation agreement, or any other agreement entered into between a Renter and a Provider. Accordingly, Book My Boat assumes no responsibility for the performance, non-performance, modification, cancellation, or execution of any charter or rental service provided by an independent Provider.
Responsibility of Providers and Renters — Each Provider is solely responsible for the ownership, condition, maintenance, seaworthiness, safety, legal compliance, licensing, insurance, and crew of the vessel. Each Renter is solely responsible for reviewing the vessel description, verifying that the vessel meets their needs, following all captain and crew instructions, and complying with all applicable laws.
Accuracy of Listings — All descriptions, photographs, pricing, amenities, availability, and other information displayed on our Services are provided by independent Providers or other third parties. Book My Boat does not guarantee that any listing is accurate, complete, current, or free from errors or omissions.
Compliance With Laws — Book My Boat is not responsible for determining whether a vessel, charter operation, captain, crew member, or Provider complies with applicable laws or regulations. Each Provider and Renter is solely responsible for complying with all applicable federal, state, local, and maritime regulations.
Separate Agreements — Certain bookings may require the Renter to execute additional agreements directly with the Provider, including Bareboat Charter Agreements, Liability Waivers, Assumption of Risk Agreements, and Security Deposit Agreements. These agreements exist solely between the Renter and the applicable Provider. Book My Boat is not responsible for negotiating, enforcing, interpreting, or resolving disputes arising under any separate agreement.
Release and Indemnification
Release of Liability — To the fullest extent permitted by applicable law, you agree that Book My Boat, its owners, officers, directors, employees, contractors, affiliates, representatives, successors, and agents shall not be liable for any claim, loss, injury, death, property damage, delay, cancellation, personal injury, financial loss, or any other damages arising out of or related to any charter or rental booked through our Services, the actions or omissions of any Provider, mechanical failures, weather conditions, navigation decisions, accidents, vessel substitutions, cancellations, or any dispute between a Renter and a Provider.
Indemnification — You agree to defend, indemnify, and hold harmless Book My Boat from and against any and all claims, lawsuits, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from or relating to your violation of these Terms, your negligence or misconduct, your use of the Services, damage caused by you or your guests, your violation of any law, or any dispute between you and a Provider.
Insurance — Book My Boat is not an insurance company, insurance broker, or insurance agent. Any insurance coverage associated with a vessel, charter, or Provider is maintained solely by the applicable Provider or the insurance company issuing such coverage. Book My Boat makes no representations or warranties regarding the existence, scope, or adequacy of any insurance policy. It is solely your responsibility to determine whether you have adequate insurance coverage for your participation in any charter.
Use of the Services
Conditions of Use — As a condition of accessing or using the Services, you represent, warrant, and agree that: (i) you are at least eighteen (18) years of age; (ii) all information you provide is true, accurate, and complete; (iii) you will use the Services solely for lawful purposes; (iv) if making a reservation on behalf of others, you have full authority to act on their behalf; (v) you are responsible for ensuring that every guest complies with these Terms; (vi) you agree to comply with all applicable boating, maritime, safety, and navigation laws; (vii) if you will operate any vessel, you are legally authorized and properly licensed; and (viii) you agree to comply at all times with the instructions of the captain and crew.
Prohibited Conduct — When using our Services, you agree that you will not: provide false information; impersonate another individual; interfere with the operation or security of our platform; use automated software or bots without authorization; upload malicious software; engage in abusive, threatening, or harassing behavior; or violate any applicable law.
Right to Refuse Service — Book My Boat reserves the right, at its sole discretion, to refuse, suspend, or terminate access to its Services, cancel reservations, or deny future bookings to any person who violates these Terms, provides false information, engages in fraudulent activity, threatens the safety of others, or whose conduct may expose Book My Boat or its Providers to legal or financial risk.
Reservation Integrity — Book My Boat reserves the right to cancel, refuse, or suspend any reservation if we reasonably believe that fraudulent payment methods have been used, false information has been provided, the reservation violates applicable law, or the reservation presents a safety, legal, or reputational risk.
Payment Services
Payment Processing — Book My Boat facilitates the collection and processing of payments for reservations made through our Services. By making a reservation, you authorize Book My Boat and any third-party payment processor to process payments on your behalf. Book My Boat may collect reservation deposits, partial payments, final balances, security deposits, taxes, service fees, processing fees, and any other charges disclosed during the booking process.
Payment Authorization — By submitting your payment information, you represent and warrant that you are the authorized holder of the payment method provided, all payment information is accurate, and you authorize Book My Boat to charge your payment method for all amounts associated with your reservation, including deposits, balances, taxes, service fees, add-on services, and damage charges.
Pre-Authorizations and Verification — Book My Boat reserves the right to place a temporary authorization hold on your credit or debit card before confirming a reservation to verify the validity of the payment method. A small temporary verification transaction may also be processed and automatically reversed after successful verification.
Payment Responsibility — You remain solely responsible for ensuring your payment method remains valid and sufficient funds are available. Failure to complete payment may result in cancellation of the reservation, denial of boarding, forfeiture of deposits, and additional collection costs permitted by law.
Declined Payments — If your payment is declined, Book My Boat may attempt to process the payment again, request an alternative payment method, suspend or cancel your reservation, refuse future bookings, or pursue any lawful remedies available to recover unpaid amounts.
Fraud Prevention — Book My Boat reserves the right to verify your identity, payment method, and billing information to prevent fraud or unauthorized transactions. We may refuse or cancel any reservation that we reasonably believe involves fraud or suspicious activity.
Third-Party Payment Providers — Book My Boat may use independent payment processors. Your payment information may be securely transmitted to those providers solely for payment processing purposes. Book My Boat is not responsible for delays, interruptions, or processing errors caused by third-party payment processors or financial institutions.
Currency — Unless otherwise stated, all prices are in United States Dollars (USD). Currency conversion fees may be determined solely by your bank or card issuer.
Third-Party Fees and Service Fees
Captain and Fuel Charges — Unless expressly stated otherwise in the vessel listing, the charter price covers only the vessel rental and any services specifically identified as included. Certain charters require additional third-party operational fees, including Captain Fees and Fuel Charges. These fees are separate from the vessel rental price. Book My Boat may collect and process these third-party fees as a payment facilitator. All such fees are payable to the applicable independent third-party service provider and do not constitute revenue of Book My Boat.
Service Fee — Book My Boat charges a variable service fee for facilitating reservations. The Service Fee is separate from the vessel rental price and represents compensation for reservation management, customer support, payment processing, and related services. The amount is determined at Book My Boat's sole discretion and may vary depending on the specific vessel, charter duration, seasonal demand, promotional offers, and other factors. The applicable Service Fee will be included in the total amount displayed before the reservation is confirmed.
Payments to Vessel Owners — Book My Boat facilitates the collection and distribution of payments. Unless otherwise agreed, payments due to vessel owners will be processed weekly for all completed charters. Book My Boat reserves the right to adjust the payment schedule in exceptional circumstances.
Payments Outside Book My Boat — All payments relating to a reservation arranged through Book My Boat must be processed through Book My Boat unless expressly authorized otherwise in writing. Any attempt to circumvent Book My Boat by arranging direct payments may result in cancellation of the reservation, suspension or termination of accounts, and other remedies.
Security Deposits and Damage Claims
Security Deposits — Certain vessels require a refundable Security Deposit, the amount of which will be disclosed before the reservation is confirmed. The Security Deposit is intended to secure the Renter's obligations under these Terms and does not limit liability for damages that exceed the deposit amount.
Responsibility for the Vessel — The Renter agrees to return the vessel in the same condition in which it was delivered, excluding normal wear and tear. The Renter is fully responsible for the actions and conduct of all guests and shall be financially responsible for any damage, loss, excessive cleaning, missing equipment, or breach of these Terms caused by the Renter or any member of the charter party.
Damage Claims — If the Provider reports damage or loss, they may submit a damage claim supported by reasonable evidence including photographs, repair estimates, written reports, and any other relevant documentation. Book My Boat will conduct a reasonable review of the available information. The Renter will be notified and given a reasonable opportunity to provide an explanation before a final determination is made, except where immediate action is necessary to prevent fraud or additional financial loss.
Authorization to Charge — By completing a reservation, the Renter authorizes Book My Boat to retain, charge, or apply all or part of the Security Deposit to cover verified losses, damages, unpaid fees, or other amounts owed. If verified damages exceed the Security Deposit, the Renter remains responsible for the full amount.
Refund of Security Deposit — If no valid damage claim exists, the Security Deposit will be released or refunded in accordance with the Provider's policies and normal banking processing times.
Vessel Substitutions and Taxes
Vessel Substitutions — The Renter acknowledges that a reserved vessel may become unavailable due to circumstances beyond Book My Boat's reasonable control, including mechanical failure, required maintenance, safety concerns, weather-related damage, or other unforeseen events. In such circumstances, Book My Boat will make commercially reasonable efforts to provide a substitute vessel of similar or greater quality. If a reasonably comparable substitute is available, the reservation shall remain in effect. If Book My Boat is unable to provide a comparable substitute, the Renter may accept an alternative vessel, reschedule, or receive a refund in accordance with the applicable Cancellation and Refund Policy.
Taxes — All charter prices, booking fees, and service fees may be subject to applicable governmental taxes as required by law. Where required, Book My Boat will calculate, collect, and remit the appropriate taxes. The customer authorizes Book My Boat to collect all applicable taxes due at the time of booking. Book My Boat reserves the right to correct any tax calculation error resulting from changes in applicable law or technical errors.
Cancellation and Refund Policy
Customer Cancellations — The Vessel Rental Price is fully refundable if the reservation is canceled at least twenty-four (24) hours before the scheduled charter departure time, unless a different cancellation policy is expressly stated in the booking confirmation. If canceled less than twenty-four (24) hours before departure, the Vessel Rental Price shall be non-refundable.
Captain, Crew, and Third-Party Operational Fees — Captain Fees, Crew Fees, Fuel Charges, and other Third-Party Operational Fees are separate and independent from the Vessel Rental Price. These amounts are collected solely as a payment facilitator. Because these Providers reserve their time and services in advance, these fees become earned and committed upon confirmation of the reservation and are non-refundable, unless the applicable Provider expressly authorizes a refund in writing. The customer expressly acknowledges that these charges shall not be disputed through a chargeback solely because the reservation was canceled.
Owner Cancellation — If the vessel owner or Book My Boat cancels a confirmed reservation due to vessel unavailability or other circumstances within our control, the customer will be entitled to a comparable replacement vessel, rescheduling, or a full refund of all amounts paid for the vessel rental.
Processing of Refunds — Approved refunds will be issued to the original payment method. Refund processing times vary depending on the customer's financial institution. Book My Boat is not responsible for delays caused by banks or payment processors.
Weather Cancellation Policy
Boating is an outdoor activity inherently dependent upon weather and water conditions. The safety of all passengers, crew members, and vessels is always the highest priority.
Captain's Authority — The licensed captain has the absolute authority to determine whether weather or water conditions permit the safe operation of the vessel. Factors considered may include high winds, thunderstorms, lightning, heavy rain, rough seas, tropical storms, hurricanes, reduced visibility, US Coast Guard advisories, or any other condition affecting safety. The captain's decision regarding safety shall be final and binding.
Weather Cancellations — If the captain determines prior to departure that weather conditions make it unsafe to operate, Book My Boat will work with the customer and vessel owner to reschedule or issue a refund of the vessel rental amount. Any refund of third-party operational fees shall be governed by the applicable policies of the independent third-party Provider.
Temporary Weather Delays — Temporary weather conditions do not automatically constitute grounds for cancellation. The captain may delay departure, modify the route, or adjust the itinerary until conditions are safe. Such operational adjustments shall not constitute a cancellation and shall not entitle the customer to a refund.
Customer Weather Cancellation — If the captain determines the charter can safely proceed but the customer chooses not to participate due to personal weather concerns, the cancellation shall be treated as a voluntary customer cancellation under the standard Cancellation Policy.
Force Majeure — Book My Boat shall not be liable for cancellations, delays, route modifications, or interruptions caused by severe weather, hurricanes, governmental emergency declarations, marina closures, or any other event beyond Book My Boat's reasonable control.
No Guarantee of Weather Conditions — Book My Boat does not guarantee sunny weather, calm seas, visibility, or any specific weather conditions. Weather forecasts are estimates only and may change without notice.
Chargeback Policy
Disputed Charges — If a customer believes that any charge processed by Book My Boat is incorrect or unauthorized, the customer agrees to notify Book My Boat in writing before initiating any dispute, chargeback, or payment reversal with their credit card issuer. Written notice must be submitted within fourteen (14) calendar days from the date the disputed charge appears on the customer's payment statement and must include the customer's full name, reservation number, the amount being disputed, a detailed explanation, and supporting documentation.
Unauthorized Chargebacks — The customer agrees not to initiate a chargeback for any charge that was properly disclosed, authorized, or incurred in accordance with these Terms, including vessel rental charges, service fees, Captain Fees, Crew Fees, Fuel Charges, security deposits properly applied, damage charges, cancellation fees, and taxes.
Collection of Outstanding Amounts — If a chargeback is resolved in favor of Book My Boat, the customer remains legally responsible for all outstanding amounts owed. Book My Boat reserves the right to recover such amounts through reprocessing the payment, collections, legal proceedings, or any other lawful means. The customer shall also be responsible for any reasonable attorneys' fees and collection costs.
Reservation Records — Book My Boat maintains reservation records, signed agreements, payment authorizations, and other documentation relating to each reservation. By completing a reservation, the customer authorizes Book My Boat to provide such information to payment processors, financial institutions, or courts as reasonably necessary to defend against any payment dispute.
Disclaimer of Warranties and Limitation of Liability
Disclaimer of Warranties — TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOK MY BOAT PROVIDES ITS SERVICES ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BOOK MY BOAT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, AND UNINTERRUPTED OPERATION.
Book My Boat does not independently inspect, certify, or warrant the condition, seaworthiness, legality, maintenance, licensing, insurance, or regulatory compliance of any vessel, captain, or Provider unless expressly stated in writing. Customers acknowledge that boating involves inherent risks and that factors beyond Book My Boat's control may affect the performance of the Services.
Limitation of Liability — TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BOOK MY BOAT, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES OF ANY KIND, WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF BOOK MY BOAT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Without limiting the foregoing, Book My Boat shall not be liable for vessel unavailability, changes in pricing or itineraries, delays, cancellations, inaccuracies in listings, mechanical failures, weather conditions, actions of any Provider, cybersecurity incidents, or loss of profits.
Maximum Liability — IF BOOK MY BOAT IS FOUND LIABLE FOR ANY CLAIM, ITS TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL SERVICE FEES ACTUALLY RETAINED BY BOOK MY BOAT IN CONNECTION WITH THE SPECIFIC RESERVATION GIVING RISE TO THE CLAIM. UNDER NO CIRCUMSTANCES SHALL BOOK MY BOAT BE LIABLE FOR ANY AMOUNTS PAID OR PAYABLE TO INDEPENDENT THIRD PARTIES.
Boating Activities — The customer expressly acknowledges that boating, water sports, swimming, snorkeling, jet skiing, and all other marine recreational activities involve inherent risks, including serious bodily injury, permanent disability, drowning, property damage, or death. Book My Boat is solely a booking facilitator and assumes no responsibility for the operation or navigation of any vessel, the conduct of any captain, or the seaworthiness of any vessel.
Intellectual Property and Arbitration
Intellectual Property — All content made available through Book My Boat's Services, including logos, trademarks, photographs, videos, graphics, software, databases, vessel descriptions, and marketing materials, is owned by or licensed to Book My Boat and is protected by applicable intellectual property laws. Your use of our Services does not grant you any ownership rights in the Content. You may not copy, reproduce, modify, distribute, or commercially exploit any Content without Book My Boat's prior written consent. Unauthorized use may violate copyright, trademark, and other laws and may result in legal action.
Unsolicited Ideas — If you voluntarily submit any ideas, suggestions, or feedback to Book My Boat, you grant Book My Boat a perpetual, irrevocable, worldwide, royalty-free license to use such submissions without compensation. Book My Boat has no obligation to review or implement any unsolicited ideas.
Agreement to Arbitrate Disputes — PLEASE READ THIS SECTION CAREFULLY. BY ACCEPTING THESE TERMS, YOU AGREE THAT MOST DISPUTES BETWEEN YOU AND BOOK MY BOAT WILL BE RESOLVED THROUGH FINAL AND BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT. YOU KNOWINGLY AND VOLUNTARILY WAIVE YOUR RIGHT TO A TRIAL BY JURY AND YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
Any dispute arising out of or relating to these Terms, any reservation, any payment, any cancellation, or the relationship between you and Book My Boat shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA). All disputes shall be resolved solely on an individual basis. Neither party may participate in a class action or class arbitration.
Exceptions — Either party may seek temporary restraining orders, injunctive relief, or protection of intellectual property rights before a court of competent jurisdiction.
Confidentiality — Any arbitration, settlement discussions, or related information shall remain strictly confidential to the fullest extent permitted by law.
Governing Law — This Arbitration Agreement shall be governed by the Federal Arbitration Act. To the extent state law applies, the laws of the State of Florida shall govern.
Identity Verification and Account Security
Identity Verification — To protect the safety of our customers, vessel owners, captains, and the integrity of our booking platform, Book My Boat reserves the right to verify the identity of any customer at any time before, during, or after the booking process. By making a reservation, you agree to provide any information or documentation that Book My Boat or the applicable Provider may reasonably request to verify your identity, including a valid government-issued photo identification, passport, driver's license, payment verification, or a live photo for identity verification.
Book My Boat reserves the right to delay, suspend, refuse, or cancel any reservation if the requested verification information is not provided, is false or misleading, or if Book My Boat reasonably believes that completing the reservation may expose any party to financial, legal, or safety risks. Any cancellation resulting from failure to complete identity verification may be treated as a customer cancellation subject to the applicable Cancellation Policy.
Account Security — If you create a customer account, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to notify Book My Boat immediately if you believe your account has been compromised. Book My Boat shall not be liable for any unauthorized reservation or fraudulent transaction resulting from your failure to safeguard your account credentials.
Fraud Prevention — Book My Boat may use third-party identity verification services and fraud detection systems. Providing false identification or fraudulent information constitutes a material breach of these Terms and may result in immediate cancellation, permanent suspension, forfeiture of fees, and referral to law enforcement authorities.
Miscellaneous Provisions
Governing Law — These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. The original version of these Terms has been prepared in English. Any translation is provided solely for convenience; the English version shall control in the event of any inconsistency.
Force Majeure — Book My Boat shall not be liable for any delay, interruption, cancellation, or failure to perform arising from events beyond its reasonable control, including hurricanes, severe weather, acts of God, governmental orders, pandemics, cyberattacks, telecommunications failures, or supply chain disruptions.
Severability — If any provision is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No Waiver — The failure of Book My Boat to enforce any provision shall not constitute a waiver of that provision.
Entire Agreement — These Terms, together with any Charter Agreement, Privacy Policy, and booking confirmation, constitute the entire agreement between the parties regarding the Services.
Assignment — You may not assign any rights or obligations under these Terms without Book My Boat's prior written consent. Book My Boat may assign these Terms in connection with a merger, acquisition, or sale of assets.
Suspension and Termination — Book My Boat reserves the right to refuse service, suspend access, or cancel any reservation if the user has violated these Terms, provided false information, engaged in fraudulent activity, initiated an improper chargeback, or violated applicable law.
Electronic Communications — By using the Services, you consent to receive communications electronically. Electronic communications shall satisfy any legal requirement that such communications be in writing.
Electronic Signatures — Electronic signatures, click-through agreements, and electronic records shall have the same legal force and effect as original handwritten signatures. The customer waives any objection based solely upon the electronic nature of any signature or record.
Survival — Provisions that by their nature are intended to survive shall remain in full force and effect after termination, including Payment Obligations, Cancellation Policy, Release and Indemnification, Disclaimer of Warranties, Limitation of Liability, Intellectual Property, Arbitration Agreement, and Governing Law.
Additional Policies
Assumption of Risk — The customer acknowledges that boating and water activities involve inherent risks, including slips, falls, drowning, collisions, changing weather, and recreational activities. By participating in the charter, the customer voluntarily assumes all such risks.
Photography and Video Release — Unless the customer notifies Book My Boat in writing before the charter, the customer grants Book My Boat permission to use photographs or videos taken during the charter for marketing and promotional purposes without compensation.
Medical Emergencies — Book My Boat does not provide medical services. In the event of a medical emergency, the captain or crew may contact emergency services. Any medical expenses shall be the sole responsibility of the customer.
Alcohol, Drugs, and Illegal Activities — Illegal drugs, unlawful conduct, violence, harassment, and illegal weapons are strictly prohibited aboard any vessel. Excessive intoxication or behavior compromising safety may result in immediate termination of the charter without refund.
Lost and Found — Book My Boat, the vessel owner, captain, and crew are not responsible for lost, stolen, or damaged personal belongings.
Minors — Children under eighteen (18) must remain under the supervision of a parent or legal guardian at all times.
Pets — Pets are permitted only when expressly approved prior to the reservation.
Customer Conduct — Customers and guests shall behave respectfully toward the captain, crew, vessel, and others. Abusive or disruptive behavior may result in termination of the charter without refund.
Safety Instructions — All passengers agree to follow the instructions of the captain and crew at all times.
Property Damage — The customer is financially responsible for any damage caused by the customer or guests.
Smoking Policy — Smoking and vaping are permitted only where expressly authorized by the captain.
Weapons — Firearms, explosives, and illegal weapons are strictly prohibited without express authorization.
Recording of Communications — Book My Boat may record and retain telephone calls, emails, text messages, and other communications for quality assurance, training, fraud prevention, and dispute resolution purposes. By communicating with Book My Boat, you consent to such recording where permitted by law.
Definitions and Interpretation
Definitions — For purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:
"Book My Boat" or "Company" means Book My Boat LLC together with its affiliates, employees, contractors, representatives, successors, and authorized agents.
"Services" means all products, services, reservations, bookings, websites, mobile applications, software, communications, customer support, payment processing, marketing activities, and any other services offered by Book My Boat.
"Customer" means any individual or entity who requests information, creates an account, makes a reservation, or uses the Services.
"Guest" means any individual participating in a reservation or charter.
"Reservation" or "Booking" means any confirmed, pending, modified, canceled, or completed reservation for any vessel or related service.
"Provider" means any independent vessel owner, captain, crew member, marina, or other third party providing goods or services in connection with a Reservation. Providers are independent contractors and are not employees, agents, or representatives of Book My Boat.
"Vessel" means any yacht, boat, catamaran, sailboat, jet ski, personal watercraft, or other watercraft offered through the Services.
"Content" means any text, photographs, videos, graphics, logos, reviews, and other information made available through the Services.
"Applicable Law" means all applicable federal, state, local, international, maritime, privacy, consumer protection, tax, and regulatory laws.
Interpretation — Unless the context requires otherwise: singular words include the plural; references to one gender include all genders; the words "including" and "such as" mean "including without limitation"; headings are for convenience only and do not affect interpretation.
Rules of Interpretation — These Terms shall be interpreted fairly and according to their plain meaning, without presuming that any provision should be construed against the drafting party. If any ambiguity arises, these documents shall be interpreted in a manner that best gives effect to their purpose and the lawful operation of Book My Boat's business.
Chargeback Policy
Disputed Charges — If a customer believes that any charge processed by Book My Boat is incorrect or unauthorized, the customer agrees to notify Book My Boat in writing before initiating any dispute, chargeback, or payment reversal with their credit card issuer. Written notice must be submitted within fourteen (14) calendar days from the date the disputed charge appears on the customer's payment statement and must include the customer's full name, reservation number, the amount being disputed, a detailed explanation, and supporting documentation.
Unauthorized Chargebacks — The customer agrees not to initiate a chargeback for any charge that was properly disclosed, authorized, or incurred in accordance with these Terms, including vessel rental charges, service fees, Captain Fees, Crew Fees, Fuel Charges, security deposits properly applied, damage charges, cancellation fees, and taxes.
Collection of Outstanding Amounts — If a chargeback is resolved in favor of Book My Boat, the customer remains legally responsible for all outstanding amounts owed. Book My Boat reserves the right to recover such amounts through reprocessing the payment, collections, legal proceedings, or any other lawful means. The customer shall also be responsible for any reasonable attorneys' fees and collection costs.
Reservation Records — Book My Boat maintains reservation records, signed agreements, payment authorizations, and other documentation relating to each reservation. By completing a reservation, the customer authorizes Book My Boat to provide such information to payment processors, financial institutions, or courts as reasonably necessary to defend against any payment dispute.
